By using the Services or by otherwise giving us your information, you will be deemed to have read, understood, and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by the Privacy Policy. Information collected by us from you may include (but is not limited to) the following:  Contact Data: Such as your email address and phone number.  Device Phonebook: With your consent, we may collect contact information from your device's phonebook. This helps users quickly add their number. Contacts information is collected in the following features: o When adding patients to OPD list o Vaccination o Share Link o Photo Tracker o Medical Record  Demographic Data: Such as your gender, date of birth, and pin code.  Usage Data: Data regarding your usage of the services and history of the appointments made by or with you through the use of Services.  Voluntary Information: Other information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters).  Payment Information: Such as your payment card number, expiration date, and billing address. By using the Service, you consent to the recording, storage, and disclosure of such communications you send or receive for these purposes.  Health Records: We may store and process prescriptions, treatment notes, recommendations, and other data generated by medical practitioners on or through the platform, and data shared by third parties such as diagnostics related information and prescription related information, and may retain such material for our records for the duration of you availing the Services or for any such period required or permitted under applicable law.  Uploading and Storing Patient's Prescription Files: Including documents and images.  Firebase Analytics and Services: We store and retrieve mobile number, name, image, and document, as well as use Firebase chat, FCM token, Quickblox auth, voice, and video call. The information collected from you by STAYCARE may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules. Definitions  Personal Information: Defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.  Sensitive Personal Data or Information: Defined under the SPI Rules to mean personal information about that person relating to: o Passwords o Financial information such as bank accounts, credit and debit card details, or other payment instrument details o Physical, physiological, and mental health condition o Sexual orientation o Medical records and history o Biometric information o Information received by body corporate under lawful contract or otherwise o Visitor details as provided at the time of registration or thereafter STAYCARE will be free to use, collect, and disclose information that is freely available in the public domain without your consent. All health records created either on the website or on the in-clinic application are based upon your consent, which is deemed to be given when you visit the website or the clinic. It is the sole responsibility of the clinic to make patients aware that the said establishment uses STAYCARE software and services. STAYCARE will not be held liable for the failure of such communication from the clinic/practitioner. If you do not want to create your record, please inform the clinic or doctor expressly. In the case that you may wish to remove such a record, you may contact us at sonbargroup@gmail.com. Note that your data may still be held after removing personal identifiers mentioned above to facilitate continued services or analysis. How Do We Use the Information We Collect? We use information we collect in a variety of ways to provide the Services on the Site and to operate our business, including: (a) Service Provision and Improvement:  To carry out our obligations arising from your requests for the products and Services on the platform.  To operate and improve the platform to foster a positive user experience and to improve our business as a whole.  To process and deliver your service requests with us.  To enable your access to our Site to provide you Services.  To enable you to initiate consultation with Medical Practitioners or facilitating next steps in the consultation.  Analyzing data, tracking trends, building algorithms, creating databases for rating systems, recommendations engines, etc.  Research.  To respond to your requests, customize your orders, improve our platform, or communicate with you.  For non-targeting reasons such as frequency capping, compliance, billing, ad reporting or delivery, market research, or product development purposes.  To comply with applicable law.  To conduct audits and quality assessment procedures.  To analyze the use of our resources, troubleshoot problems, and improve our products and Services, by using the information regarding your mobile device and software.  Contacting users, both during and after an order, for updates, resolution of queries, order details, consultations, follow-up consultations, or offering new services.  To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms, or as otherwise required by law.  To respond to any queries that you may have, and to communicate information to you, including notifications of any promotions or alerts, any changes/updates to the Site, or the introduction of any future fees or charges that we may collect at the time for purchasing products or provision of our Services to you.  To contact you, by way of SMS, email, and phone calls, from time to time to record your valuable feedback on our products and Services, as they currently stand, and/or any potential products and services that may be offered in the future. Privacy Statements Applicable to Practitioners All Users Note: This section applies to all users. A condition of each User’s use of and access to the Services is their acceptance of the Terms of Use, which also involves acceptance of the terms of this Privacy Policy. Users who do not agree with any provisions of this Privacy Policy have the option to discontinue the Services provided by STAYCARE immediately, including access to the website and other products. An indicative list of information that STAYCARE may require you to provide to enable your use of the Services is provided in the Schedule annexed to this Privacy Policy. A User may access the Website without creating an account but can make appointments by providing their name and phone number through the Mobile Application. During registration and the application creation and submission process available to Practitioners on STAYCARE, certain information, including Personal Information or Sensitive Personal Data or Information, is collected. Key Points: 1. Information Collection and Use: o Practitioners’ personally identifiable information is used to help describe and identify themselves. This information is owned by STAYCARE, but Practitioners retain ownership of their information. o STAYCARE may use this information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis, and business intelligence. o Information may also be used for:  Publishing on the Website.  Offering new products or services.  Taking feedback.  Analyzing software usage patterns and anonymized practice information for commercial use. 2. Website Listing: o STAYCARE automatically lists Practitioners’ information on the Website for every ‘Doctor’ or ‘Clinic’ added to a Practice using its software. This information is displayed when End-Users search for doctors and request appointments. o STAYCARE does not generate this information but displays it as provided by Practitioners or collected from the public domain. Practitioners should verify the accuracy of their information and inform STAYCARE of any discrepancies or updates. 3. Non-Registered Practitioners: o STAYCARE may display information for Practitioners who have not registered but have consented to the collection and disclosure of their information. STAYCARE makes efforts to capture accurate information but does not guarantee its completeness. End-Users Note This section applies to all End-Users. During registration or application submission on the Website, certain information, including Personal Information or Sensitive Personal Data or Information, is collected. Key Points: 1. Information Collection and Use: o End-Users’ personally identifiable information is used to describe or identify themselves. Non-personal information collected (e.g., usage patterns) is owned by STAYCARE and may be used for research, statistical analysis, and business intelligence. o Anonymized End-User demographics and health information may be used for:  Improving product design and utility.  Developing new technologies.  Commercial product offerings.  Sharing with third parties for commercial use. 2. Communication Preferences: o STAYCARE communicates with End-Users through email, phone, and other means. End-Users can change their communication preferences via their account settings at www.staycare.com. 3. Data Retention: o STAYCARE may keep records of communications and calls for administration, customer support, and research. All employees and data processors must respect confidentiality and follow security procedures. 4. Disclosure and Transfer: o STAYCARE may disclose or transfer End-Users’ information to third parties as part of reorganization or asset sale, with the right to use such information according to the Terms of Use. Casual Visitors Note No sensitive personal data or information is automatically collected from casual visitors of this website. STAYCARE may send email and/or SMS confirmations or other communications to End-Users in connection with their bookings, appointments, or other interactions facilitated by STAYCARE. Traffic Data Collected We automatically track and collect the following categories of information when you visit our Site:  IP addresses  Domain servers  Types of devices accessing the Site  Types of web browsers used to access the Site  Referring source which may have sent you to the Site  Other information associated with the interaction of your browser and the Site (collectively "Traffic Data") Interactive and Installed Tools We collect other information, some of which may be Personal Information that you voluntarily provide to us when using our interactive tools and services ("Interactive Tools"), such as searching for Providers and available appointments. These partners are bound to uphold the same security and confidentiality standards and can only use your Personal Information to fulfill their business obligations.  During a merger, sale, or acquisition, your information may be transferred to another company.
